Sebastian County couple enters not guilty plea after leaving minor child in locked car on July 6 in Fort Smith

A trial date of December 2 of this year has been set for a Greenwood couple who stand accused of leaving a minor child in a locked car while they were shopping at Walmart on July 6th. 


According to information from Arkansas Court connect, David and Brenda Carver, both of Greenwood, we're arrested by the Fort Smith Police Department at the Walmart Supercenter on North 62nd Street (Kelley Highway) after officers had to break out a window and unlock a car when they arrived to find a minor child in distress inside the hot vehicle. 


According to information from the National Weather Service,  temperature at 4:00 p.m. on July 6 was 95°. The temperature inside a car rises to 114° after 10 minutes. After 20 minutes it reaches 124° and after 40 minutes 133°.


While there is no information on how long the child was in the car, EMS did respond to the scene and provided medical care to the unnamed minor. 


In addition, when the ' appeared in court earlier in the week, they both were placed under a no offensive contact order which prohibits them from directly or indirectly communicating with the child, who was only identified by their initials. 


After police arrested 61-year-old David Carver, he was asked if there was anyone else with him at the scene. He said that his wife Brenda, 57, was still in the store. 


She was also arrested by the Fort Smith police department and both were transported to the Sebastian County Detention Center. Both remained in jail until July 11th when they were released on a $2,000 legally sufficient bond.


Both Carvers pleaded not guilty on Wednesday to Endangering the Welfare of a Minor in the First Degree - Conduct. The couple is being tried together after a July 17 Order for Joinder of the defendants was issued by the court.
