Update: Public defender withdraws from case involving sexual assault of a 14-year-old female

A Dyer man we first told you about back in November that was arrested for Sexual Assault in the Second Degree and Producing, Directing or Promoting a Sexual Performance by a Child charges, remains jailed o a $50,000 pond and is awaiting for new counsel to be appointed in his case.


Today in Fort Smith has learned that Crawford County Public Defender Ryan Norris withdrew from the case in mid-January because of a conflict of interest and Rickey Leakey, 45, is awaiting the Arkansas Public Defender Commission to appoint substitute counsel.


Also, since our original story, the affidavit information has been released and other information has come to light about Leakey.


Leakey's charges, a Class D and Class B felony respectively, stem from activities involving Leakey and a 14-year-old female relative. There was a 31-year age difference between Leakey and the defendant at the time of the alleged assault.


Class D felonies convictions are the least serious felonies in Arkansas, punishable by up to six years in prison and a fine of up to $10,000. The sentence for a Class B felony is five to 20 years in prison and a fine of up to $15,000.


According to information from Arkansas Court Connect, Leakey engaged in "sexual conduct" with the victim several times, including a threesome with Leakey and his girlfriend. Text messages of a sexual nature were exchanged between Leakey and the victim and Leakey also sent the victim pictures (via Snapchat) he had taken of her at his place of residence.

According to a source, Leakey lived in Larned, Kansas for nearly a decade and worked security at a Correctional Mental Health Facility. He also has ties to Ozark, Hartman, and Clarksville, and possibly Russellville, according to the same source.
