The most heinous crimes in our society involve the abuse of minor children. But to sexually abuse a minor child who resides in your own household is especially disgusting, as it violates the dignity of the family unit and betrays the fundamental trust that children place in those responsible for their care and protection.
James Daniel Caldwell, born August 28, 1972, was charged with exactly that type of betrayal. According to Madison County court records, over a period spanning from 2012 to September 6, 2019, Caldwell engaged in at least a dozen acts of sexual intercourse or deviate sexual activity with a minor child while serving as the victim’s guardian.
On October 3, 2019, Prosecuting Attorney Matthew Durrett of the Fourth Judicial District filed an Information in Madison County Circuit Court charging Caldwell with 12 counts of Rape, a Class Y felony under Arkansas Code. The charges highlighted Caldwell’s position of authority over the victim in the household.
Caldwell entered a guilty plea in open court before Circuit Judge Mark Lindsay. In the signed Plea Questionnaire, he confirmed that he understood the charges and potential sentences. He voluntarily waived his right to a jury trial and other constitutional protections, stating his plea was knowing and voluntary.

On June 22, 2020, Judge Lindsay sentenced Caldwell to 270 months (22 years and 6 months)Â in the Arkansas Division of Correction.
Caldwel is currently housed at the Grimes Unit. He is classified as C4 custody with a projected PAROLE ELIGIBLE date of March 21, 2036
These types of crimes inflict profound and lasting harm on the most vulnerable members of our society -- children who depend on adults in their own homes for safety and security.
Such violations not only shatter the innocence of the victim but also erode the foundational trust within families and communities across Northwest Arkansas.
