Frivolous lawsuits and false police reports impose significant financial burdens on states, draining resources and diverting attention from more legitimate claims.
These abuses of the legal system not only affect the coffers of various community and county budgets, they often divert important focus of court officials and law enforcement officers from the investigation and enforcement of actual crimes being committed by unsavory elements.
In Arkansas, the state has measures in place to recover court costs, witness fees, and attorney fees in cases deemed frivolous, with a cap of $10,000. Despite this cap, the administrative and legal costs can still be considerable.
Additionally, filing a false police report is a Class D felony if it results in over $500 in investigation costs, physical injury, or another person's arrest. Uncooperative law enforcement agencies who refuse to reveal the cost associated with such investigations often make it hard for injured parties to see any justice despite having their name and reputation dragged through the mud.
Oklahoma faces similar challenges. The state's legal system also deals with frivolous lawsuits that can drain resources and divert attention from more legitimate claims. The costs include direct legal fees and the time and effort spent by state employees and officials.
Like Arkansas, Oklahoma imposes strict penalties for filing false police reports, which can lead to significant financial burdens on the state.
However, countries and towns in less urban and sophisticated areas are also hampered by budget concerns, under-trained investigators and police officers, understaffed courts, and apathetic judges. Those conditions often add up to injustices against victims of malicious prosecutions resulting from such actions.
Many times, actions by plaintiffs to attempt recovery from false police reports or malicious prosecution are met with a blind eye by law enforcement and the courts who try to divert the issue by claiming the illegal actions should be handled in civil court. Often times those efforts are made in an effort to sidetrack what is viewed as potential criticism, or in the case of elected officials, the effect on future elections.
While precise annual figures for the cost of frivolous lawsuits and false police reports in both states are difficult to obtain, the financial impact is substantial.
Efforts to curb frivolous litigation and false reports, such as stricter filing requirements and penalties for baseless claims, are essential to reduce these costs and ensure an efficient and just legal system.
Unfortunately, with all the flaws in the current system, the true victims of false reports and malicious prosecution rarely get to see the justice due to them in an overwhelming majority of these cases.
