Thirty-five year-old Springdale man in custody facing one count of Second Degree Sexual Assault


A 35-year-old Springdale man was booked into the Washington County Detention Center just after 7 p.m.. Friday and was charged with one count of Sexual Assault in the Second Degree, according to online booking information from the Washington County Sheriff's Office.


Jose Moreno-Gamez, residing in the 1400 block of Prairie Street in Springdale remains behind bars on a non bond hold pending aa Rule 8.11 hearing set for Monday morning in Washington County Circuit Court.


Calls to the WCDC were referred to the detective who made the arrest for further information. The circumstances surrounding the incident leading to the arrest have not been released.


Sexual Assault in the Second Degree is defined by an individual engaging in sexual contact with another person by forcible compulsion who is incapable of consent because he or she is physically helpless, mentally defective; or mentally incapacitated.


It also applies if the victim is less than fourteen years of age is the attacker is over the age of eighteen.


Second-degree sexual assault is a Class B felony and he maximum sentence is 20 years in prison an fines of up to $15,000.
