A 41-year-old former Fort Smith resident, who was already doing time in the state prison system, was sentenced to an additional 25 years in Sebastian county circuit Court on Thursday for two theft by-receiving charges from October of last year.
Derek k Harvey was sentenced as a habitual offender in the theft by receiving cases stemming from an October 14th incident. He was also charged with a parole violation at that time and a petition to revoke on previous felonies was issued seven days later.
Harley, who had appeared with public defender Cash Haaser, sought a motion to continue in the case but that was denied. He then pled guilty as charged in the two theft-by-receiving cases.
Harvey must also pay restitution to five different individuals totaling over $17,400 once he is released from prison.
Harvey has listings on Arkansas Court Connect dating back to 1999 for a number of felony charges. In that 1999 court proceeding, he was found guilty of forgery and breaking or entering and received suspended imposition of sentences on both charges.
