Plea deal results in lesser charge in under-aged sex sentencing for Fort Smith offender

A Fort Smith resident who was originally arrested and charged as an adult with one count of Rape back in June of this year was sentenced to five years in prison this week after taking a plea dead on a reduced charge of Sexual Assault in the Second Degree.


Court records indicate that Dajun Dustin Byes of Fort Smith entered the guilty plea to the amended charges in a court proceeding Wednesday in Sebastian County Circuit Court. Byes was seventeen at the time of the violation according to in

In addition to the imposed sentence, Byes also drew fifteen years suspended, He was given credit for time served since his August arrest on the charges. He was also assessed court cost, jail fees and sex offender registry fees totaling $431 that he will have to begin paying nine


ty days after his release from prison at $60 per month.


He was also ordered to register as a sex offender and to have no further contact with the victim.


Byes awaits transfer to the Arkansas Department of Corrections at the Sebastian County Adult Detention Center.
