A concurrent sentence of 28 years with a dozen year suspended on drugs and firearm charges against a 27-year-old Fort Smith man was levied and Sebastian County Circuit Court Wednesday according to information released from the Fort Smith Police Department.
Devonta Montel Hoes, listed as homeless in booking records with the Sebastian County Adult Detention Center, was placed on an ADC commitment hold after his conviction on Wednesday.
Hoes was arrested February 6 of this year and charged with simultaneous possession of drugs and firearms, possession of a controlled substance, trafficking in a controlled substance, and delivery of fentanyl.
Hoes posted a legally sufficient $50,000 bond six days after his arrest and was released from custody. He remained free until his court date on Wednesday.
Once again, the sentence was delivered after a plea deal on Wednesday. The office of Sebastian County prosecutor Daniel Shue decline to prosecute the trafficking charge as part of the plea deal. Also as part of the plea agreement rendered in front of Circuit judge Steven Tabor Hoes is to forfeit any items seized during his arrest.
As of 11:00 a.m. Friday morning, the 27-year-old remained in the custody of the Sebastian County Adult Detention Center awaiting has transferred to the ADC.
