Plea deal on reduced charge lands Fort Smith man in jail with a modified five-year sentence



A 48-year-old Fort Smith man who had been free on bond since his January arrest for trafficking ina scheduled I/II controlled substances is free no more after a Wednesday morning session in Sebastian County Circuit Court.


David Edward Nichols, who was charged with one count of drug trafficking after his arrest on January 24 of this year, entered a guilty plea to a reduced charge during a Wednesday morning session of Circuit Court in Fort Smith.


Nichols, who's listed address with the court is in the 3500 block of Glenn Flora Way in Fort Smith, appearing with Deputy PubliD defender Patrick Fake at his hearing, saw his charge reduced from trafficking to possession of fentanyl, a Class C felony, and entered a guilty plea in open court.


Edwards was handed a five -year sentence plus fove years suspended on the charge. The court deemed that he could serve his sentence in a local county jail if he is found eligible for that consideration.

Edwards had been free on a $25,000 bond since two days after his January 24 arrest.

In addition to the fiove-year sentence, Edwards must provide the court with a DNA sample and will lose his driving privileges for 6 months once released from jail.
