Non-compliant sex offender given additional time on top of current prison sentence

A Level 4 sex offender with a proclivity for failing to register as such will have a stable address for the next several years after being sentenced to an additional 120 months in prison for his latest lapse in judgement.


Terry Dean Smith, 62, who was convicted of Rape sometime before 2015, was already in prison on a number of charges when he was returned to Sebastian County last week to stand trial on the Failure to Register charge. He was arrested in February of this year after being paroled and was sent back to the ADC on a felony petition to revoke.


Smith, who committed his original sex crime in Ouachia County, was intially arrested by the Fort Smith Police Department in 2015 for the same violation, has a history of non-compliance and violence.


He also was given an additonal twenty-years suspended.


Smith was arrested in January of 2015 after officials in Canden contacted the US Marshal Service in an effort to track him down after he feld from that county. The Marshal Service arrested him as he tried to pick up a check from a former employer. He was also charged at that time with aggravated assault with a firearm case and terroristic threatening,


The failure to report charges that sent Smith back to prison last week were the third time he had been arrested for the same crime.
