At approximately 9:30 a.m. on Wednesday, July 2, Fort Smith Police arrested 31-year-old Colby Cole of Lavaca in connection with a July 1 report of lewd behavior near the splash pad and pavilion area at Riverfront Park.
Cole was booked into the Sebastian County Adult Detention Center on a preliminary misdemeanor charge of Public Sexual Indecency. Police say additional charges may be considered as the investigation continues.
This is not Cole’s first encounter with law enforcement. His most recent arrest prior to this incident occurred on June 28, 2025—just days earlier—on a charge of Criminal Trespass.
Cole’s arrest history includes:
2025: Criminal Trespass (June 28)
2023: Battery on a Law Enforcement Officer, Refusal to Submit to Arrest, multiple counts of Criminal Trespass, Fleeing on Foot, and Failure to Appear
2022–2020: Multiple charges of Criminal Trespass, Failure to Appear, and Contempt for Failure to Pay Fines
The Fort Smith Police Department expressed appreciation for the public’s swift reporting, which allowed officers to respond quickly. Authorities urge residents to continue reporting suspicious activity by calling 479-709-5000.
