Four counts involving child pornography sends Fort Smith 21-year-old to state prison for five years

A 21-year-old Fort Smith man was sentenced on Thursday to five years with fifteen years suspended on a Class B felony and five years with five suspended on each of three Class C felonies stemming from an October 2020 arrest on four counts of Distributing, Possessing, or Viewing of a Matter Depicting Sexually Explicit Conduct with a Child.


Anthony Nguyen, who lived in the 5100 block of Clarendon in Fort Smith, picked up a total of 5 years in imposed sentences with 30 years total suspended for the crimes, but was granted concurrent status on all counts.


The status of charges involving child pornography changes after the first three counts and transitions to the more serious Class B designation after the fourth violation. Because of the concurrent status of his sentence Nguyen was essentially sentenced to the five-year term for the Class B felony.


Someone convicted of a Class B felony in Arkansas becomes eligible for parole after just over four-and-a-half months in jail after his original arrest, Nguyen should date sometime become his first parole eligible date sometime in the late fall of 2024.
