Battery causing injury sends repeat offender to ADC for twelve years with eighteen years suspended


A 39-year-old Fort Smith resident was sentenced to twelve years in prison with an additional eighteen years suspended after a guilty plea on Domestic Battering in the First Degree charges in Sebastian County Circuit Court.


Russell A. Dempsay, whose address is listed in the 33oo block of Jenny Lind Road was arrested on three domestic battery counts and one count of possession of drug paraphernalia on August 25 of this year. Because he had been convicted of domestic battering within the past five years and the assault caused injury to the victim the count was upgraded to a felony.


Dempsay was given credit for jail time served, since he has remained in the Sebastian county Adult Detention Center since his arrest on a no bond hold as recommended by the prosecutors office. In addition to the jail time, Dempsay was ordered to have no contact with the victim once he is released from prison.


Dempsay will also come of of prison facing payments on $281 in court cost, jail fees and public defender fees
